Girls Rock IT: Cybersecurity

These terms and conditions must be checked (accepted) in order to complete registration.   

By checking this box, you agree to all terms and conditions of this Participation Agreement (“Agreement”) between the Michigan Council of Women in Technology Foundation (“MCWT” and you (collectively, the “parties”). 

A. Conduct Requirement: As the parent or guardian of the applicant to the MCWT Program (“Applicant”) I agree and the Applicant understands that, while at the MCWT Program, Applicant is a guest at a place of business.  As such, we agree that Applicant will follow all rules and procedures in place or explained to Applicant while at the MCWT Program, and she will act with proper decorum at all times. If, in the sole discretion of MCWT, Applicant does act consistently with this Conduct Requirement, MCWT may dismiss Applicant from Girls Rock IT at any time and retain all fees for participation in the program.  

B. Medical Treatment: In case of a medical emergency, I understand that MCWT will exert its reasonable best efforts to contact parents or guardians of Applicants. In the event that I cannot be reached, I, the parent or legal guardian of this Applicant, delegate MCWT representatives and/or her teacher to authorize and consent to any and all medical, surgical, dental, or hospital care or treatment while she is at the MCWT Program. Such treatment is to be rendered by, or under the jurisdiction of a duly licensed physician, nurse, or dentist. I provide authorization for any medical personnel to act in accordance with their best judgment in such an emergency and absolve MCWT, the Applicant’s teacher, any sponsoring entity and the host entity from any liability or financial responsibility in connection therewith.  

C. Facility Covid Protocol: I agree that the Applicant understands and will adhere to the Event location’s Covid protocol which may include: social distancing, frequent hand washing, mask wearing, and not attending the MCWT Program if she has any Covid symptoms or comes in contact with anyone with Covid or Covid symptoms, while participating in the MCWT Program. I also agree and acknowledge that the event location’s Covid protocol may change between now and the date the MCWT Program is held and that regardless of the protocols in place at the time of the event, Applicant will understand and follow such protocols. 

D. Media Release:  I consent to the use of Applicant’s name, pictures, images and likeness, written stories, video footage, audio recordings, voice and/or opinions (“Materials”) for any purpose including but not limited to advertising, promotional, or other commercial use.  I understand and agree that MCWT  owns all rights, title, and interest in and to the Materials, and I hereby assign to MCWT, or MCWT’s assignees including, but not limited to, any Girls Rock IT sponsor or the entity hosting the MCWT Program, as MCWT directs (collectively, “MCWT Parties”) all copyright and other intellectual property rights that I may have in the Materials.     

I hereby grant to the MCWT Parties, their legal representatives, assigns, and heirs, the unrestricted and irrevocable right and permission to use, reproduce, distribute, publish, display, transmit, create derivative works of and perform publicly the Materials, including but not limited to broadcasting, webcasting, podcasting or other transmission of the Materials, in whole or in part, in any and all media now or hereafter known, including but not limited to the Internet and social media, for promotion, art, advertising, trade or any other purpose whatsoever.  I acknowledge and agree that the MCWT’ Parties’ right to use the Materials includes the right to use all portions, composites, distortions or alterations thereof.  I acknowledge and expressly agree that no compensation shall be paid to me, Applicant, our heirs or assigns for the rights granted in this Media Release or for any use of the Materials by the MCWT Parties. I hereby waive any right to inspect or approve the Materials or any use of the Materials.  

I hereby release the MCWT Parties, their legal representatives, employees, assigns, and heirs, from any and all liability, claims and demands arising out of or in connection with the use of the Materials, including without limitation any claims for libel, invasion of privacy, right of publicity, personal injury, property damage or loss of services.  I agree not to take any legal action against the MCWT Parties, or any entity acting on its behalf, in connection with the use of Materials and I agree that I have no right, title or interest in the Materials or any work into which they are incorporated.   

I acknowledge that I have read and understand this Media Release and I agree to its terms and conditions.  This Media Release shall be binding upon me and my heirs, successors, representatives, and assigns.   

E. Participation Authorization and Release: In exchange for Applicant’s participation in Girls Rock IT, (the “Activity”), I hereby agree as follows:   

1. I, as parent or legal guardian of Applicant, hereby grant the permission necessary to allow Applicant to participate in this in-person and/or virtual event, competition, training, class and/or camp ("Activity") to be conducted by MCWT. I, on my own behalf and on behalf of the Applicant, further agree to release and to hold harmless MCWT, a non-for-profit corporation, MCWT’s corporate sponsors (hereinafter “Sponsors”), the sponsoring location (hereinafter the "Location"), the affiliates of MCWT, and the respective directors, officers, representatives, members, agents, and employees of the preceding parties (hereinafter collectively “Releasees”).  I and anyone claiming on my behalf release and forever discharge Releasees in their individual and corporate capacities from causes of action of any nature and kind, known or unknown, which I may have against any of the Releasees arising out of or relating to an injury, loss or damage to person or property that may be sustained as a result of participation in the Activity (“Claims”).   

2. I understand that participation in the Activity involves inherent risks, including risk of physical or psychological injury, pain, suffering, illness, and I assume all related risks on behalf of Applicant, and I am voluntarily choosing to have Applicant participate in the Activity.  

3. I agree to indemnify Releasees against any and all claims, actions, lawsuits, damages, and judgments, including actual attorney’s fees, arising out of, or relating to Applicant’s participation in the Activity.   

4. This Agreement and the releases herein shall not be in any way construed as an admission by the Releasees a) that any of them has acted wrongfully with respect to me, Applicant or any other person; b) of any liability or responsibility at any time for any purpose; c) that any of them is aware of any inherent danger or threat posed by the Activity; or d) that I or Applicant have any rights whatsoever against any of the Releasees.   

F. General Terms: 

1. This Agreement shall be binding upon the parties and the Applicant and their respective heirs, administrators, personal representatives, executors, successors, and assigns. I have the authority to release the Claims and have not assigned or transferred any Claims to any other party. The provisions of this Agreement are severable. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Agreement constitutes the entire agreement between the parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Agreement. This Agreement may not be altered, amended, or modified except by a written document signed by both parties. The terms of this Agreement shall be governed and construed in accordance with the laws of Michigan.   

2. Any action or proceeding concerning any Claim or the meaning of any provision of the Agreement shall be governed by Michigan law and shall be conducted in Oakland County, Michigan or in the United States District Court - Eastern Michigan District, and that for such purposes, I expressly submit to the jurisdiction of such courts.   

3. I have carefully read and fully understand all the provisions of this Agreement and I am freely, knowingly, and voluntarily entering into this Agreement.
